Article 1 (Purpose)

The purpose of these Terms of Service ("Terms") is to define the conditions of use, procedures, and the rights and responsibilities of users for the browser extension "WAQM Pro" (hereinafter the "Program"), developed by "Ji" (hereinafter the "Developer"). By installing or using the Program, you agree to be bound by these Terms. If you do not agree, do not install or use the Program.

Article 2 (Services Provided)

The Program operates within the WhatsApp Web environment and provides the following features:

  • Quick insertion and transmission of pre-saved text messages, with folders and labels.
  • Contact labels, customer information (CRM), and private note-taking.
  • Message translation and AI-assisted drafting via MyMemory, DeepL, Microsoft Translator, OpenAI (GPT), and Google (Gemini).
  • Custom translation prompts, translation style presets, and chat translation popups.
  • World clock widgets and shortcuts to favorite websites.
  • Optional local (JSON) and Google Drive backup and restore.

Article 3 (Use of External APIs and User Responsibility)

  • To use translation and AI features, users may issue and register their own API keys (e.g., Google Gemini, OpenAI, DeepL, Microsoft Translator) or email registration (MyMemory).
  • All responsibilities regarding the issuance, usage, quota, and any billing or charges associated with these API keys rest entirely with the user. The Developer bears no responsibility for any fees, overages, or costs incurred through the user's use of paid third-party APIs.
  • Users must comply with the terms of service and usage policies of each respective provider. Any violation of a third party's terms is the sole responsibility of the user.
  • API keys entered by the user are stored only in the user's local browser storage and are never transmitted to or collected by the Developer.

Article 4 (Privacy and Data Handling)

  • The Program stores user-generated data (quick messages, labels, customer information, notes, settings, API keys) only within the user's local browser storage. The Developer does not operate any server and does not collect or receive this data.
  • When the user actively uses translation or AI features, the relevant text or image is sent directly from the user's browser to the third-party service selected by the user. This transmission occurs solely to provide the requested result and is subject to that provider's privacy policy.
  • If the user chooses the Google Drive backup feature, data is uploaded to the user's own Google Drive account; the Developer does not store this data.

Article 5 (Disclaimer of Warranties)

  • The Program is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.
  • The Developer does not warrant that the Program will be uninterrupted, error-free, secure, or free of viruses or other harmful components, nor that any defects will be corrected.
  • The Program is an independent utility and is not endorsed by, affiliated with, sponsored by, or in any way officially connected to WhatsApp Inc., Meta Platforms, Inc., Google, OpenAI, or any other third party.

Article 6 (Limitation of Liability)

  • To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of data, loss of profits, business interruption, or reputational harm, arising out of or related to the use of, or inability to use, the Program.
  • The Developer shall not be liable for any account restrictions, suspensions, bans, or data loss imposed by WhatsApp, Meta, or any third-party platform resulting from the use of this Program. The user assumes all operational risks.
  • The Developer shall not be liable where features become partially or fully unavailable due to changes in third-party platform policies, API modifications, service outages, deprecation, or discontinuation (including WhatsApp, Google, OpenAI, DeepL, Microsoft, and MyMemory).
  • As the Program is provided free of charge, the user agrees that the Developer's total aggregate liability, if any, shall not exceed the amount actually paid by the user for the Program (which is zero).

Article 7 (AI Translation Disclaimer)

  • Translation and AI-generated results are produced by third-party engines and may contain errors, inaccuracies, mistranslations, or inappropriate content. The Developer does not guarantee the accuracy, completeness, or suitability of any translation or generated text.
  • The user is solely responsible for reviewing and verifying any translated or generated content before use. The Developer shall not be liable for any damages, misunderstandings, business losses, or legal consequences arising from reliance on such results.
  • Users must not use the Program to generate or transmit unlawful, harmful, abusive, or otherwise prohibited content.

Article 8 (Data Loss and Backup)

All user data is stored locally and, optionally, in the user's own Google Drive. The user is solely responsible for maintaining their own backups. The Developer shall not be liable for any loss of data resulting from browser data clearing, extension removal, updates, device failure, or any other cause. Users are strongly encouraged to use the export/backup feature regularly.

Article 9 (Amendments to the Terms)

The Developer reserves the right to amend these Terms to reflect functional updates or regulatory compliance. Any modifications will be disclosed via the Chrome Web Store update notes or in-app notices. Continued use of the Program after such changes constitutes acceptance of the revised Terms.

Article 10 (Severability & Governing Terms)

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between the user and the Developer regarding the Program.

제1조 (목적)

본 약관은 개발자 'Ji'(이하 "개발자")가 제공하는 브라우저 확장 프로그램 'WAQM Pro'(이하 "프로그램")의 이용 조건 및 절차, 사용자의 권리와 의무에 관한 사항을 규정함을 목적으로 합니다. 사용자가 본 프로그램을 설치하거나 이용하는 경우 본 약관에 동의한 것으로 간주되며, 동의하지 않는 경우 프로그램을 설치·이용하지 마시기 바랍니다.

제2조 (제공 서비스)

본 프로그램은 WhatsApp Web 환경에서 다음 기능을 제공합니다.

  • 미리 저장된 텍스트 메시지의 신속한 입력·전송 (폴더 및 라벨 지원)
  • 연락처 라벨, 고객 정보(CRM), 개인 메모 관리
  • MyMemory, DeepL, Microsoft Translator, OpenAI(GPT), Google(Gemini)를 활용한 메시지 번역 및 AI 초안 생성
  • 사용자 정의 번역 프롬프트, 번역 스타일 프리셋, 채팅창 번역 팝업
  • 세계 시계 및 자주 방문하는 사이트 바로가기
  • 선택적 로컬(JSON) 및 Google Drive 백업·복원

제3조 (외부 API 사용 및 사용자 책임)

  • 사용자는 번역 및 AI 기능을 이용하기 위해 본인의 API 키(예: Google Gemini, OpenAI, DeepL, Microsoft Translator) 또는 이메일 등록(MyMemory)을 직접 등록할 수 있습니다.
  • API 키의 발급, 사용, 사용량 및 이와 관련된 모든 요금·과금에 대한 책임은 전적으로 사용자 본인에게 있습니다. 개발자는 사용자의 유료 제3자 API 이용으로 발생하는 어떠한 비용, 초과 요금, 손실에 대해서도 책임지지 않습니다.
  • 사용자는 각 제공사의 서비스 약관 및 이용 정책을 준수해야 하며, 제3자 약관 위반에 대한 책임은 전적으로 사용자에게 있습니다.
  • 사용자가 입력한 API 키는 사용자의 브라우저 로컬 저장소에만 저장되며, 개발자에게 전송되거나 수집되지 않습니다.

제4조 (개인정보 및 데이터 처리)

  • 본 프로그램은 사용자가 생성한 데이터(빠른 메시지, 라벨, 고객 정보, 메모, 설정, API 키)를 사용자의 브라우저 로컬 저장소에만 보관합니다. 개발자는 어떠한 서버도 운영하지 않으며 해당 데이터를 수집·수신하지 않습니다.
  • 사용자가 번역 또는 AI 기능을 직접 사용할 경우, 해당 텍스트 또는 이미지는 사용자가 선택한 제3자 서비스로 사용자의 브라우저에서 직접 전송됩니다. 이는 요청한 결과 제공을 위해서만 이루어지며 해당 제공사의 개인정보 처리방침을 따릅니다.
  • 사용자가 Google Drive 백업 기능을 선택하는 경우, 데이터는 사용자 본인의 Google Drive 계정에 업로드되며 개발자는 이를 저장하지 않습니다.

제5조 (보증의 부인)

  • 본 프로그램은 "있는 그대로(AS IS)" 및 "이용 가능한 상태(AS AVAILABLE)"로 제공되며, 상품성, 특정 목적에의 적합성, 정확성, 신뢰성, 비침해에 대한 묵시적 보증을 포함하여 명시적·묵시적·법정 보증을 일절 제공하지 않습니다.
  • 개발자는 프로그램이 중단 없이, 오류 없이, 안전하게 작동하거나 바이러스 및 기타 유해 요소가 없음을 보증하지 않으며, 결함이 수정될 것임을 보증하지 않습니다.
  • 본 프로그램은 독립적인 유틸리티로서 WhatsApp Inc., Meta Platforms, Inc., Google, OpenAI 및 기타 제3자로부터 보증·후원·제휴받거나 공식적으로 연관되어 있지 않습니다.

제6조 (책임의 제한)

  • 관련 법률이 허용하는 최대 범위 내에서, 개발자는 프로그램의 사용 또는 사용 불능으로 인해 발생하는 직접적, 간접적, 부수적, 특별, 결과적, 징벌적 손해(데이터 손실, 이익 손실, 영업 중단, 명예 훼손 등을 포함하되 이에 국한되지 않음)에 대해 책임지지 않습니다.
  • 개발자는 본 프로그램 사용으로 인해 WhatsApp, Meta 또는 제3자 플랫폼이 부과하는 계정 제한, 정지, 차단, 데이터 유실에 대해 책임지지 않습니다. 사용자는 모든 운영상의 위험을 스스로 부담합니다.
  • 개발자는 제3자 플랫폼의 정책 변경, API 수정, 서비스 장애, 지원 중단 또는 서비스 종료(WhatsApp, Google, OpenAI, DeepL, Microsoft, MyMemory 등 포함)로 인해 기능의 일부 또는 전부가 이용 불가능해지는 경우에 대해 책임지지 않습니다.
  • 본 프로그램은 무료로 제공되므로, 개발자의 총 누적 책임은 (있다 하더라도) 사용자가 프로그램에 대해 실제로 지불한 금액(즉, 0원)을 초과하지 않는 것에 사용자가 동의합니다.

제7조 (AI 번역 관련 면책)

  • 번역 및 AI 생성 결과는 제3자 엔진에 의해 생성되며 오류, 부정확성, 오역 또는 부적절한 내용을 포함할 수 있습니다. 개발자는 번역 또는 생성된 텍스트의 정확성, 완전성, 적합성을 보증하지 않습니다.
  • 사용자는 번역 또는 생성된 콘텐츠를 사용하기 전에 이를 검토·확인할 전적인 책임이 있습니다. 개발자는 해당 결과에 의존하여 발생하는 손해, 오해, 영업 손실, 법적 결과에 대해 책임지지 않습니다.
  • 사용자는 본 프로그램을 불법적, 유해한, 악의적인 또는 기타 금지된 콘텐츠의 생성·전송에 사용해서는 안 됩니다.

제8조 (데이터 손실 및 백업)

모든 사용자 데이터는 로컬 및 선택적으로 사용자 본인의 Google Drive에 저장됩니다. 사용자는 자신의 데이터 백업을 유지할 전적인 책임이 있습니다. 개발자는 브라우저 데이터 삭제, 확장프로그램 제거, 업데이트, 기기 고장 또는 기타 원인으로 인한 데이터 손실에 대해 책임지지 않습니다. 사용자는 내보내기/백업 기능을 정기적으로 사용하실 것을 강력히 권장합니다.

제9조 (약관의 변경)

개발자는 프로그램의 기능 개선이나 관련 법령의 변경이 있을 경우 본 약관을 개정할 수 있습니다. 약관이 변경될 경우 크롬 웹스토어의 업데이트 노트 또는 프로그램 내 공지를 통해 고지하며, 변경 이후에도 프로그램을 계속 사용하는 경우 개정된 약관에 동의한 것으로 간주됩니다.

제10조 (분리 가능성 및 완전 합의)

본 약관의 어느 조항이 무효이거나 집행 불가능한 것으로 판단되더라도, 나머지 조항은 계속 완전한 효력을 유지합니다. 본 약관은 프로그램에 관한 사용자와 개발자 간의 완전한 합의를 구성합니다.
